Introduction

For our purposes, this type of contractor is any individual trader, partnership, or body corporate that we may wish to contract with that does not fit into the other two categories of being a self-employed individual who will only supply materials and their personal labour, or an individual with whom we have entered into a casual employment contract to be paid under our PAYE scheme.

This category also excludes individuals providing their time through a >personal services company, and all agency workers.

These contractors will be required to carry a minimum of £5m Public Liability insurance cover, or £10m if they are to work on sites where our clients require the higher cover.

If their work includes an element of design, they will also be required to carry at least £1m professional indemnity insurance cover to match our own.

The larger the firm, the higher our expectations will be to see them demonstrate their competency to carry out the work requested of them, evidenced by formal professional business and individual worker qualifications, recognised trade body and institutional accreditations.

They will be expected to provide us with copies of their written H&S Policies and deliver specific, sufficient and relevant risk assessments and method statements for every project they undertake for us before their operatives step onto site.

It will be necessary to draw up a sufficient and relevant commercial contract of engagement for every project that is undertaken in order to establish the respective responsibilities and obligations of all stakeholders in the arrangement, the timing of the delivery of the services, and the arrangements to be made on site for the health, safety and welfare of all operatives whilst the work is underway.

One of the important restrictions of the arrangement is the contractor is not permitted to engage another contractor to assist them complete the work on our site without our express written permission. We will not authorise the sub-contractor to begin work, until we have undertaken our normal on-boarding and project specific reviews. If they do not pass our review, alternative arrangements will need to be made. For these reasons, it is essential sufficient notice must be given by the lead contractor to advise us of the need to involve another contractor. They will be held liable for all costs arising from delaying the project's timetable as the reviews are undertaken.
